Copyright and takedowns

A notice we can act on has all of these. Missing pieces slow it down.

1. The work you own that you believe has been copied.
2. The link to the track on this site. The artist page URL and the track title is enough.
3. Your name, address, phone number and email.
4. A statement that you believe in good faith the use is not authorised by you, your agent, or the law.
5. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them.
6. Your physical or electronic signature.

• When a complete notice arrives, the track comes down. It leaves the feed, the artist page and the charts, and the audio is deleted from our servers.
• The artist is told, with the reason, on their own track page. They can see what was claimed but not who claimed it.
• The notice is kept on record against the uploader.

You can send a counter notice to the same address. It needs:

1. The track that was taken down.
2. A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
3. Your name, address and phone number.
4. A statement that you consent to the jurisdiction of the federal court for your district, or for ours if you are outside the United States, and that you will accept service from the person who sent the notice.
5. Your physical or electronic signature.

Once we receive it, the track can be restored after 14 days, unless the person who sent the notice tells us they have taken you to court over it in that time. If the notice is withdrawn, it can come back sooner.

A notice that stands, meaning it was not withdrawn and no counter notice succeeded, counts against the account that uploaded the track. After three, that account can no longer upload.
